The nerve-racking process of a job interview is to determine whether you are suited to the vacant position – but there are questions which legally can’t be asked. 

Questions are designed to decide whether your skill sets are suited for the job or to find the appropriate person for the role.

Any information regarding age, ethnicity, religious or sexuality can’t be posed by the interviewer.

The top questions bosses aren’t allowed to ask have been revealed as they are deemed as factors which are relevant to any job

Questions that employers can’t legally ask  

  • Are you in a same-sex relationship?
  • How old are you?
  • What’s your ethnic background?
  • What religion are you?
  • Are you pregnant or planning to start a family?
  • Who do you vote for?
  • Do you have a physical or mental disability?

These are deemed as factors which are relevant to any job. 

More surprisingly asking whether the applicant is pregnant or planning to start a family are illegal for bosses to question.

Voting preference or whether you have a physical or mental disability are also not allowed. 

According to Trent Hancock, the Principal Lawyer at employment law firm McDonald Murholme said, there are exceptions to this.  

‘If a person was applying for a role at a warehouse that required heavy lifting, it would be lawful for the employer to ask about a physical disability insofar as it affected the interviewee’s ability to perform heavy lifting,’ he told Seek. 

Regardless of whether the question is illegal or not you can decline to answer.

‘If an interviewer steps out of line and asks an unlawful question, politely decline to answer the question on the basis that the answer is not relevant to your ability to perform the role,’ he said.
